What is the Social Security Disability Process?

Application:
We will professionally prepare your application and walk you through the process. The first step in the Social Security Disability process for both Social Security Disability Insurance (SSDI) and Supplemental Security Income (SSI) is the Social Security Administration (SSA) application itself, which can be difficult to complete. Besides the actual application, there are forms you will need to gather for your application, such as the following:
- Proof of U.S. Citizenship or lawful presence in the U.S., e.g. Birth certificate
- Social Security Card
- Information about who and where you have received treatment (e.g. Hospital & location, physician information)
A) Request for Consideration
In some states, following an application denial, there is a request for reconsideration because many applicants are initially denied. A request for reconsideration must be made within 60 days of the date of the initial application decision. During reconsideration, a different reviewer evaluates your disability and makes a decision.
B) Administrative Hearing
In other states, following an application denial, there is an opportunity to present the case in person at an administrative hearing.
Appeals Council
If you have already been denied, we can still help you to obtain benefits. Even if your case is denied after a hearing, it can be appealed. The Appeals Council is a board within the Social Security Administration (SSA), which will make a new decision about your case or send the case back to the administrative judge for a new hearing.
District Court
