Typically, Social Security takes 6-8 months to make a decision once the application is filed. The applications are worked in date order and there is currently a sizable back log at every Social Security Field Office in the country. In the meanwhile, it is extremely important that you contact our office with updates to your medical treatment and/or providers. Social Security will contact you, and our office, for additional information that is required to make a decision.

Social Security Disability cases are handled by our Social Security Benefit lawyers and disability representatives who are experts in the Social Security Disability process.

According to the Social Security Administration, you can work and earn up to $1220 gross per month this year and still be eligible for benefits. If you earn any more than this, you are technically not eligible for benefits. Please keep track of all your earnings if you work while your case is pending. You can also call your county’s Health and Human Services Department for assistance with possible financial aid.

Medical records are a vital part of your claim. If you are unable to see a doctor for financial or insurance reason, please visit www.nafcclinics.org for a list of free clinics in your area. You can also call your county’s Health and Human Services Department for assistance with Medicaid.

Your benefit amount is based on your lifetime earnings record or your current income and resources.  That amount is determined by Social Security for each claimant. Unfortunately, we do not have access to that information.  You will need to get that information directly from Social Security.

If you are awarded benefits, you may receive a lump sum of back benefits. If you are not awarded benefits, we receive nothing. Therefore, you will not owe our office anything. If there is a lump sum, we will receive $6,000 or 25%, whichever is less. This check will come directly to our office and you will not have to worry about it.

SSDI (Social Security Disability Insurance) is for people who are so disabled they cannot work. SSI (Supplemental Security Income) is for people who do not qualify for SSDI and are still unable to work. Retirement is for eligible people who have paid into Social Security long enough to qualify for this benefit.
